Despite your company policies, if you fear an employee is EEOC bound, check your policies closely. As an example, 3 employees from Corinthian College had went to the Equal Employment Opportunity Commission with complaints that they were discriminated against due to their race. Corinthian policy is that email accounts are deleted 30 days from end of separation. This is where the fines came from. Due to not covering all of their bases, even with knowing the issues facing them, they still deleted the email accounts. When in trial with the EEOC, it was determined that since the email accounts were deleted, proper evidence may have been discarded, totaling in a $25,000 fine and responsibility for all plaintiffs’ legal fees no matter the final outcome at trial.
