OFCCP Posts New Directive On Gender Identity and Sex Discrimination

As of June 30, 2014 the DOL has announced that it shall be enforcing protocols and nondiscrimination guidance that adheres to the full protection of the federal nondiscrimination laws regarding gender and transgender status discrimination.   This directive will reaffirm that in compliance evaluations and complaint investigations the OFCCP will fully investigate and seek to remedy any infractions against those that have discriminated due to an individual’s gender identity or their transgender status.  The directive explains that, when instances are investigated for potential discrimination, OFCCP will adhere to the existing Title VII framework as outlined in the Federal Contract Compliance Manual.
